DUI Treatment Court Program

Second time DUI offenders, or first time DUI offenders with a high blood alcohol concentration (BAC) that meet DUI Treatment Court entry requirements, may be offered the opportunity by the Attorney General’s Office to participate in the DUI Treatment Court Program to avoid incarceration.

The New Castle County Drug Treatment Court Program is available at our Lancaster Avenue Treatment Center. The Kent County Drug Treatment Court Program is located at our Milford Treatment Center.

  • Intake Information

Individuals must be 18 years old or older. Second time DUI offenders, or first time DUI offenders with a high blood alcohol concentration (BAC), may be considered. Eligibility is determined by the Attorney General’s Office, and a risk and needs assessment is completed with the court. The individual must be high risk, high needs, and approved by the Attorney General’s Office to be accepted in the DUI Treatment Court Program.

Once an individual is sentenced to the DUI Treatment Court Program, they complete a scheduled intake at the identified BCCS Treatment Center within the next week. During intake, level of care and appropriate services are determined. All services are provided by BCCS, unless additional services from an external provider are required.
